Can you tell me exactly what you are doing when you get the message that "program was unable to download correctly"? I googled that exact phrase and got exactly 0 results.

What is strange is I have this exact same problem and message on my new dell laptop running Windows 8, so the Direct X is the latest version available.

You don't need the latest direct X, you need direct x 9.0c.
